{"id":2333,"date":"2016-06-13T06:05:22","date_gmt":"2016-06-13T06:05:22","guid":{"rendered":"http:\/\/rdactionconsultant.com\/en\/?p=320"},"modified":"2025-11-27T18:29:33","modified_gmt":"2025-11-27T18:29:33","slug":"questions-before-audit-for-sred","status":"publish","type":"post","link":"https:\/\/rdactionconsultant.com\/en\/blog\/questions-before-audit-for-sred\/","title":{"rendered":"SR &#038; ED Audit : what do we do ?"},"content":{"rendered":"<div class=\"vgblk-rw-wrapper limit-wrapper\">\nThat&#8217;s it !\u00a0You received the fateful call (or letter)!\u00a0Your SR &amp; ED claim is selected for an audit!<\/p>\n<p>The audit by the CRA is certainly THE crucial moment in the claiming process for SR &amp; ED tax credits.\u00a0We can avoid an audit, but we can certainly minimize the negative impacts.\u00a0In the first of a series of six articles on the audit of a SR &amp; ED claim, we begin with the announcement of the visit.<\/p>\n<h2>The questions BEFORE the audit meeting<\/h2>\n<p>That money is important to you, whether it is $ 50,000 or $ 500,000.\u00a0Furthermore, they often audit two or even three years at a time.\u00a0That&#8217;s a lot of money on the table !!!<\/p>\n<p>What do you do now ?\u00a0You have three choices:<\/p>\n<ul>\n<li>Panic,<\/li>\n<li>Stand pat,<\/li>\n<li>Get ready for that audit meeting.<\/li>\n<\/ul>\n<p>These are two bad choices and good one.\u00a0Are you ready to face it?<\/p>\n<div class=\"citation-quote\"> This is YOUR money and YOUR R&amp;D tax credit claim.\u00a0Ask\u00a0for more information. You can not be overprepared. <\/div>\n<h2>Understanding what is coming<\/h2>\n<p>First of all, you must ask the right questions to prepare appropriate responses.\u00a0Most of these questions are answered in the letter or call announcing the audit.\u00a0If the answers are not there,\u00a0<a href=\"https:\/\/www.cra-arc.gc.ca\/txcrdt\/sred-rsde\/pblctns\/gd-tchrvw-eng.html\">you have the right\u00a0<\/a>as a taxpayer to get satisfactory answers to these questions.\u00a0Call back the signatory and ask these questions BEFORE the meeting.<\/p>\n<h3>What type of meeting is it?<\/h3>\n<ul>\n<li>Is it a first-time claimant advisory service (FTCAS) meeting\u00a0where\u00a0the claim is pre-approved ? Then the CRA personnel assigned to your claims wants to meet with you\u00a0and explain the program.<\/li>\n<\/ul>\n<ul>\n<li>Is it a courtesy, a review or an audit meeting ?\u00a0The name can vary but the goal remains the same : take a deeper look\u00a0into one or more aspects or the totality\u00a0of your claim.<\/li>\n<\/ul>\n<h3>Who will be there?<\/h3>\n<ul>\n<li>The Financial Reviewer (FR) only or the Research and Technology Advisor (RTA), or both?<\/li>\n<\/ul>\n<ul>\n<li>Are these the same advisors\u00a0that\u00a0your\u00a0encountered\u00a0at your last\u00a0 audit?<\/li>\n<li>How long\u00a0have they been in charge of your claims?<\/li>\n<\/ul>\n<ul>\n<li>If the Financial Reviewer comes alone, does\u00a0this\u00a0mean that the technical claim is accepted\u00a0?\u00a0or will the Research and Technology Advisor come at a later meeting?<\/li>\n<\/ul>\n<ul>\n<li>Who do they want to meet?\u00a0The technical manager of the project(s), the head of the costing ?\u00a0A\u00a0particular\u00a0employee ?\u00a0Why them ?<\/li>\n<\/ul>\n<ul>\n<li>Do they know your R&amp;D consultants ?\u00a0Some consultants are better perceived by the CRA than others.\u00a0Will their\u00a0presence\u00a0at\u00a0the meeting be favorable or not for your claim?\u00a0Yes, you can ask them.<\/li>\n<\/ul>\n<h3>What is the purpose of the meeting &#8211; what are the issues?<\/h3>\n<ul>\n<li><a href=\"https:\/\/www.cra-arc.gc.ca\/txcrdt\/sred-rsde\/pblctns\/gd-tchrvw-eng.html\">You have the right<\/a>\u00a0as\u00a0a\u00a0taxpayer to\u00a0informed\u00a0in\u00a0advance about the issues, the main reasons for this meeting.\u00a0What will be\u00a0under review ?\u00a0What are the issues to be resolved ?\u00a0Again, do not satisfy yourself with generalities\u00a0like\u00a0&#8220;a\u00a0little everything \u201c\u00a0or\u00a0&#8220;the uncertainties&#8221;.\u00a0What uncertainties are they talking about?\u00a0Why this one does not seem eligible?\u00a0What are the issues ?\u00a0The costs ?\u00a0\u00a0Their magnitude?\u00a0Why ? The level of claimed resources?\u00a0The documentation ?\u00a0etc &#8230;<\/li>\n<\/ul>\n<ul>\n<li>Knowing their preoccupations you will better prepare\u00a0you will give them the right answers\u00a0to\u00a0their questions.\u00a0The process will\u00a0simply be even clearer and faster.\u00a0Is the problem a specific project ?\u00a0Or the link between the costs and\u00a0activities claimed ?\u00a0What are, according to\u00a0you,\u00a0the\u00a0stakes with this project?<\/li>\n<\/ul>\n<ul>\n<li>If a subset of projects is\u00a0selected,\u00a0does\u00a0this\u00a0mean that all the others are accepted?\u00a0or is it a test before\u00a0auditing the others?<\/li>\n<\/ul>\n<h3>Do they need additional information BEFORE the match?<\/h3>\n<p>Normally you must be prepared to provide basic information (costs schedules per project, prototypes, team structure, etc.) during the meeting.\u00a0They expect to see all the documents you have checked in lines 270-282 of the <strong><a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/forms-publications\/forms\/t661.html\">T661\u00a0form<\/a><\/strong>.\u00a0You can demonstrate cooperation by asking if they need additional information BEFORE the meeting.<\/p>\n<p>The additional information request is often a clue to what is being sought.\u00a0But one must know the issues as see by the auditors to clarify your position on these.<\/p>\n<ul>\n<li>They ask detailed schedules per activity\u00a0by resource?\u00a0There\u00a0is probably an issue\u00a0with the\u00a0scale of efforts\u00a0claimed.\u00a0They may\u00a0be\u00a0looking\u00a0for a cost-cutting logic.<\/li>\n<\/ul>\n<ul>\n<li>They ask for\u00a0architecture,\u00a0analysis documents\u00a0or plans?\u00a0There are possible issues with the technological uncertainties.\u00a0How can you\u00a0show that\u00a0the challenges\u00a0sought were beyond\u00a0standard practice?\u00a0What was standard practice at that time ?\u00a0The &#8220;normal&#8221; way\u00a0to proceed?\u00a0What extra did you do and why?<\/li>\n<\/ul>\n<h3>How long is planned for the meeting?<\/h3>\n<p>It takes up to half a day to review a standard project.\u00a0A longer meeting may indicate that the CRA advisors want to go further, they are skeptical about one or more of the projects.\u00a0Ask them what they expect from this meeting: more technical information, demos, prototypes, etc.\u00a0??\u00a0The set-up of a demo or prototype can be heavy in preparation but it rarely brings results in convincing the CRA.\u00a0You have a right to know if this is what they expect, and whether it will help to convince them.\u00a0What is their agenda of the meeting?<\/p>\n<p>Clear answers to these questions and others are necessary for you to prepare for the audit meeting.<\/p>\n<p>Go for more information, this is YOUR money and your claim.\u00a0You can not be too prepared.<\/p>\n<p>In the next article we will see why it is essential to prepare for the audit meeting.<\/p>\n<p>What do you think ?\u00a0Have you experienced circumstances where you had no idea of what was coming until the &#8220;train was on you&#8221;?\u00a0How did you react when receiving the call audit?\u00a0Why ?<\/p><\/div>\n<p><!-- .vgblk-rw-wrapper --><\/p>\n","protected":false},"excerpt":{"rendered":"<p>That&#8217;s it !\u00a0You received the fateful call (or letter)!\u00a0Your SR &amp; ED claim is selected for an audit!
